What Is Chapter 7 Bankruptcy?

If you are new to the idea of bankruptcy, then you may be wondering how the entire process works. There are many bankruptcy options available for all types of debtors, including consumers or businesses. Generally speaking there are two major types of consumer bankruptcies: Chapter 7 and Chapter 13.

Chapter 7 bankruptcy is also known as the "liquidation" bankruptcy. A Chapter 7 is a procedure where a debtor hands his or her assets, minus exempt property, over to a bankruptcy trustee. The trustee will then sell the assets and distribute the proceeds to all applicable creditors or lenders. Under Chapter 7, a debtor can discharge various types of unsecured debt such as credit card debt, medical bills, personal loans and past-due utility bills.

The types of debt that cannot be discharged in a Chapter 7 include the following:

  • Spousal support or alimony
  • Child support
  • Certain taxes
  • Court ordered fines
  • Victim restitution
  • Debts for willful or malicious injuries
  • Debts for most government funded educational loans
  • Debts for personal injury having to do with DUI accidents
  • Debts for certain condominium or cooperative housing fees

Because the "nonexempt property" of many Chapter 7 filers amounts to little to no value, many Chapter 7 cases are considered "no asset" cases. This essentially means that the debtor will not lose anything.
